Consider the collection of PII in the following scenario and answer the questions below.
A medical patient with a terminal illness has given consent for the collection of their PII to occur and for this personal and private data to be used in the treatment of their condition specifically, but also in any research into the detection, treatment, and prevention of this disease in general. Not only will this data include information such as the patient’s name, age, and other demographic information, but also the result(s) of any tests conducted on the patient, specimens of the patient’s biological materials, and computer models relating to the diagnosis, treatment, and progression of the patient’s medical condition.

1. This question has two parts:
a. Identify any relevant legislation in North America or Europe that defines what
constitutes PII in the scenario above and/or governs its use. Remember that
this private information will be stored in – and transmitted by – computer
systems.
b. Identify the key differences, definitions, or approaches taken by various
countries in the identification/definition, management, and security of
personally identifiable information in a medical context.
2. Can PII be owned? If so, by whom and if it can be owned can that ownership be
transferred? Justify your position/answers with support from scholarly/academic/peer
reviewed sources (minimum of 3 sources).
3. This question has two parts:
a. Now imagine the patient in the scenario above has died, and researchers of
other diseases are requesting access to the patient’s PII data for their own
research. Releasing this information would violate the terms of the initial
consent given by the patient that stated the PII would be restricted to research
into their specific disease. Since the patient is now deceased, would it be
ethical for the hospital to release/share the specimens obtained for use in other
medical research where the results could save countless lives? How could the
country where the research is being performed play a role in this decision?
b. If the sharing of PII as described above took place, what frameworks,
measures, or controls would you recommend in order to ensure that appropriate
safeguards were in place and adhered to?
4. In the event of a data breach, what would be the best way to minimize the impact
from that breach?
