Scenario:

You work for a healthcare consulting company. A small physician’s practice has asked you to
submit a proposal for the creation of a compliance program. There are 3 physicians in the
practice, they do not have a Board of Directors. The practice currently has no compliance
program and the physicians that own the practice are not convinced they actually even need a
program. You job is to write a memo outlining the following points:

1. (10 points) What is the legal justification for the program? Cite existing law and
regulations to make the argument why it is in the best interest of the practice to have a
program. What are the benefits? What could happen if they do not have a program?
2. (70 points) Explain the elements of the program that you would put in place. For each
element discuss the following:
a. What process would you use to determine how to implement each element in
this unique setting? How would you tailor that particular element to the
practice?
b. What would this element look like in actual operation? How would it work?
What would it do?
c. How would you measure that element over time to ensure that it is effective?
3. (10 points) What types of things would you compliance program be focused on
preventing? Remember what type of organization this is, be specific.
4. (10 points) Use full sentences. Grammar, spelling, and the strength of your arguments
all count. Just because you submit responses that are factually correct, does not mean
that you will receive full points. You need fully formed, logical, and complete answers.
